Tenants rights act in force from May 1st what does it mean for both tenants and landlords

With so much information out there we thought it might be useful to share the main points of the new law with anyone visiting this site who is interested in renting

  • End of “No fault” (section 21) Evictions: landlords will no longer be able to evict tenants without a specific legal reason
  • Abolition of Fixed-Term Tenancies: all new and existing assured shorthold tenancies (ASTs) will convert to rolling periodic tenancies
  • New Possession grounds: Landlords must use specific section 8 grounds if they wish to end the tenancy
  • Tenant Notice Periods: Tenants will be able to end a tenancy at any time by giving two months’ notice
  • Rent in Advance: tenants can no longer be asked to pay rent in advance, as such Cityzen have already established a relationship with a professional rent guarantee company to underwrite tenants such as overseas students, this will allow tenants to pay monthly while ensuring the landlord is protected against default or late payment of rent
  • Rent Increases: Once a year the landlord can review/increase the rent in line with current rental values by serving a section 13 notice at least 2 months prior
  • Right to keep pets: Tenants have a legal right to request a pet which can’t be unreasonably refused by the landlord however certain building lease restrictions will constitute a reasonable refusal
  • Decent Homes Standard (DHS): This will now be applied to the private rental sector for the first time ensuring properties are both safe and compliant

Of course, this is just a snapshot of the new law and Cityzen welcomes these changes.
